Promotional Gift Card Terms and Conditions

A. General

  1. These terms and conditions (Terms and Conditions) apply to the use of promotional gift cards which have been issued by ORIDON Pty Ltd (ABN 84 637 392 842) of Unit 9/6 Enterprise Drive, Rowville VIC 3178 (ORIDON) as part of a promotion (Promotional Gift Cards).
  2. Please refer to clause 19 of these Terms and Conditions with details of how ORIDON manage the personal information that ORIDON may collect from you with respect to Promotional Gift Cards.
  3. Your use or redemption of your Promotional Gift Card constitutes your acceptance to be bound by these Terms and Conditions. 
B. Using your Promotional Gift Card
  1. Your Promotional Gift Card is issued as a promotional offer and is not redeemable for cash.
  2. Your Promotional Gift Card can be used for purchases of goods and services online at oridon.com.au (ORIDON Website), on any purchase that meets or exceeds the minimum spend advertised on your Promotional Gift Card.
  3. Goods and services purchased using your Promotional Gift Card are subject to ORIDON’s Terms and Conditions of Sale.
  4. When you use your Promotional Gift Card for an online purchase, by entering the unique code provided on the Promotional Gift Card online, you authorise ORIDON to deduct the value of the purchase from the value of the Promotional Gift Card. Purchases exceeding the value of the Promotional Gift Card require payment by you of the difference, by an alternate payment method (such as credit card).
  5. Your Promotional Gift Card can only be used once. It is your responsibility to redeem the full value of the Promotional Gift Card in one transaction before the expiry date specified on your Promotional Gift Card. No change will be given for any unspent portion of the Promotional Gift Card.
  6. Goods that are purchased in whole or in part with your Promotional Gift Card may be returned, exchanged or replaced subject to ORIDON’s Return Policy and in accordance with Australian Consumer Law. Where Goods are returned, ORIDON will deduct the value of your Promotional Gift Card from any refund provided to you.
C. Exclusions
  1. Your Promotional Gift Card cannot be used in conjunction with any other promotions, discounts or offers.
  2. Your Promotional Gift Card cannot be used for the payment of store accounts.
  3. You cannot exchange your Promotional Gift Card for a different denomination or for another form of tender, cash or discount. For example, you cannot exchange or redeem your Promotional Gift Card for any other form of gift card.
  4. Promotional Gift Cards cannot be reloaded.
D. Expiry and Validity
  1. Your Promotional Gift Card is valid until the expiry date specified on your Promotional Gift Card.
  2. On expiry of your Promotional Gift Card, ORIDON will have no further obligations in respect of your Promotional Gift Card, your Promotional Gift Card will become automatically invalid and any unused balance will not be refunded or credited.
E. Changes to these Terms and Conditions
  1. ORIDON reserves the right to vary or amend these Terms and Conditions where change is required for the following reasons:
    1. where ORIDON, acting reasonably, considers that it will not be to your detriment; or
    2. to comply with any law, regulation or statute or order or judgement of any court, tribunal or other body having competent jurisdiction; or
    3. to add or vary conditions for administrative or operational reasons or to prevent the occurrence of fraud or other unlawful conduct.
  2. The varied terms will be published on the Website and will become effective from the date of publication on the Website.

G. Privacy

19. Any Personal Information (as defined in the Privacy Act 1988) that ORIDON may collect with respect to Promotional Gift Cards will be used and shared as described in ORIDON’s Privacy Policy , which is incorporated in these Terms and Conditions.

H. Lost or Stolen Promotional Gift Cards

  1. You are responsible for the use and security of your Promotional Gift Card. You are liable for all transactions on your Promotional Gift Card (except to the extent of any fraud of negligence by ORIDON or its employees).
  2. You should treat this Promotional Gift Card like cash. Damaged, lost or stolen Promotional Gift Cards will not be replaced, refunded, redeemed or returned.
I. Limitation of Liability
  1. Nothing in these Terms and Conditions is intended to exclude or modify any non-excludable statutory rights under the Australian Consumer law or any other applicable laws. Other than those statutory rights that cannot be excluded, any conditions implied by any other laws are excluded from these Terms and Conditions.
  2. To the maximum extent permitted by law, ORIDON will not be liable to you for any loss or damage (including direct, indirect special or consequential loss) arising out of or related to your use of or inability to use your Promotional Gift Card. 
J. General Matters
  1. (Severability) If any of these Terms and Conditions are determined by any court or other competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  2. (Events Outside ORIDON’s Control) ORIDON will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events outside our reasonable control (being a Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: strikes, lockouts or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, pandemic, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government.
  3. (Governing Law) These Terms are governed by the laws of the State of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts in Victoria, Australia.
  4. (Australian Consumer Law) References in these Terms and Conditions to the ‘Australian Consumer Law’ means the Australian Consumer Law as found in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
